In a move reminiscent of the tobacco-cancer cover-up, a federal judge
in Nebraska, has sided with Big Abortion against women victimized by
the abortion industry and against the will of the people. Last week,
Judge Laurie Smith Camp blocked enforcement of an "informed consent
law" passed by Nebraska's unicameral legislature (LB 594), only one day
before it was due to go into effect.
This bill set clear standards for informed consent for abortion.
Enacted this spring to become effective July 15, 2010, this law would
help ensure that women receive important medical information about
abortion's harms before being subjected to an abortion. In enacting
this new law, the Nebraska legislature expressly found that "the
existing standard of care for preabortion screening and counseling is
not always adequate to protect the health needs of women." But on June
28th, Planned Parenthood of the Heartland sued to avoid its obligations
under this new law.
The Coalition on Abortion/Breast Cancer has long observed that many
women are not informed fully about the harm of abortion, and they
decide to have an abortion because they are often not fully informed.
But based on one-sided evidence, Judge Laurie Smith Camp found that
"the effect of LB 594 will be to place substantial, likely
insurmountable obstacles in the path of women seeking abortions in
Nebraska" and that "Plaintiffs have presented substantial evidence that
disclosures mandated by LB 594, if applied literally, will require
medical providers to give untruthful, misleading and irrelevant
information to patients."
The Judge's second finding is particularly troubling because the
Coalition on Abortion/Breast Cancer had filed a motion with the Court
to submit an amicus brief and affidavits from medical experts in
support of the law, and the experts' affidavits explain the harms
caused by abortion. Based on these expert affidavits, the Coalition on
Abortion/Breast Cancer's brief pointed out that the new law does not
require providing any "untruthful, misleading and irrelevant"
information to patients. But Planned Parenthood opposed consideration
of our submission. The Court ruled for Planned Parenthood not only in
blocking this good law, but also in blocking its consideration of our
amicus brief.
Women considering abortion need to become aware of the enormous harm
that it often causes, including the increased risk of breast cancer.
The abortion industry has stridently denied well-proven medical harm,
such as higher incidences of breast cancer in post-abortive women,
which makes informed consent laws so essential.
Judge Laurie Smith Camp has inflicted tremendous harm on women in
Nebraska. Because of her biased decision, Big Abortion will continue to
keep pregnant women in the dark about the risks of abortion and these
unfortunate women will continue to unknowingly expose themselves to the
deadly disease of breast cancer and the risk of emotional harm.
The victims of abortion in Nebraska deserve a speedy appeal in defense
of this good law. Hopefully, people of good will in Nebraska will
appeal the Judge's decision.
